Terms of Service for Spikey Bot

Welcome to Spikey! These Terms of Service (“Terms”) govern your access to and use of the Spikey Discord bot, including all related features, games, economy systems, websites, and services (collectively, the "Service"). Please read these Terms carefully before using the Service.

By inviting, accessing, or using the Spikey Bot in any way, you signify your agreement to be bound by these Terms. If you do not agree to all of these Terms, you may not access or use the Service. You also agree to comply with the Discord Terms of Service and Discord Community Guidelines.

1. Eligibility and Account

You must be at least 13 years old (or the minimum age required for Discord use in your country) to use the Service. By using Spikey, you represent that you meet this age requirement.

Your use of the Service is tied to your Discord account. You are responsible for maintaining the security of your Discord account. Any actions taken through your Discord account within the Service will be considered actions taken by you.

2. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial entertainment purposes.

3. Acceptable Use

You agree to use the Service responsibly and lawfully. You agree not to:

• Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
• Violate or encourage others to violate the rights of third parties, including intellectual property rights.
• Spam, harass, threaten, or defraud other users or the developers of the Service.
• Use automated means (such as scripts, bots, spiders, scrapers, or userbots) to access, interact with, or collect information from the Service, except where explicitly permitted by us (e.g., standard bot interaction).
• Attempt to gain unauthorized access to the Service, user accounts, computer systems, or networks connected to the Service through hacking, password mining, or any other means.
• Interfere with the operation of the Service or any user's enjoyment of it, including by uploading or disseminating viruses, adware, spyware, worms, or other malicious code, or by placing an unreasonable load on our infrastructure.
• Attempt to decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Service.
• Exploit any bugs, glitches, or unintended mechanics in the Service for personal gain or to disrupt the experience of others. Report such issues responsibly through designated channels.
• Engage in "real money trading" (RMT) – selling, buying, or trading Spikey virtual currency, items, or Premium access for real-world money, other game currencies, cryptocurrencies, Discord Nitro, or any other form of real-world value outside the Service.

Violation of these rules may result in temporary or permanent suspension of your access to the Service, at our sole discretion.

4. Virtual Economy and Items

The Service includes a virtual economy featuring in-bot currency ("Spikey Coins") and virtual items or cosmetics. You acknowledge and agree that:

• This virtual currency and these items are part of the Service, provided under the license granted in Section 2.
• They have no real-world monetary value and cannot be redeemed, exchanged, sold, or traded for real money, goods, or services outside of the Service.
• We have the absolute right to manage, regulate, control, modify, and/or eliminate such virtual currency or items as we see fit in our sole discretion, and we shall have no liability to you or any third party for the exercise of such rights.
• All purchases of virtual items or currency are final and non-refundable, except as required by applicable law or at our sole discretion.

5. Premium Features

We may offer optional premium features, subscriptions, or one-time purchases ("Premium Features").

• Payment for Premium Features is typically handled through third-party processors (e.g., Patreon, Stripe). Your transaction with these processors is subject to their terms and privacy policies.
• Premium Features are provided under the license in Section 2 and are non-transferable between Discord accounts.
• We reserve the right to modify, add, or remove Premium Features at any time.
• Access to Premium Features may be revoked without refund if you violate these Terms.
• Refunds for Premium Features are generally not provided, except where required by law or determined on a case-by-case basis at our sole discretion. Contact support for billing inquiries.

6. User Data

Our collection and use of your limited Discord information (User ID, Username, Server ID, etc.) is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.

7. Intellectual Property

The Service, including its visual interfaces, graphics, design, compilation, information, data, computer code (including source code or object code), products, software, services, and all other elements ("Materials") are protected by intellectual property and other laws. All Materials are the property of the Spikey developers or our third-party licensors. Except as expressly authorized by us, you may not make use of the Materials. We reserve all rights to the Materials not granted expressly in these Terms.

8. Service Availability and Modifications

We strive to keep the Service operational, but it is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We reserve the right to modify, suspend, or discontinue the Service (or any part or feature thereof) at any time, with or without notice.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account (request data deletion), please follow the instructions in our Privacy Policy or contact us.

Provisions of these Terms that, by their nature, should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Disclaimers; No Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, BE SECURE, OR BE ERROR-FREE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE SPIKEY DEVELOPERS, THEIR AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE. UNDER NO CIRCUMSTANCES WILL WE BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN.

12. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide reasonable notice prior to any new terms taking effect, often via an announcement in our official Discord server or by updating the effective date. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
